Last Updated: October 15, 2026

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE WEBSITE, YOU AGREE TO BE BOUND BY THEM.

Welcome to IndySkiPass.com (the “Website”). These Terms of Use (“Terms”) are a legally binding agreement between you and Indy Ski Pass, LLC (“Indy,” “we,” “us,” or “our”) governing your access to and use of the Website and all associated webpages, content, functionality, accounts, communications, and services made available through the Website. These Terms govern Website access and use only. They do not govern the purchase, activation, renewal, redemption, or use of an Indy Pass product, which are subject to separate passholder terms and conditions.

By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Website.

1. ELIGIBILITY; CHILDREN UNDER 13

You represent and warrant that you have the legal authority and capacity to enter into these Terms; that your use of the Website complies with applicable law; and that information you provide to Indy is accurate, current, and complete. If you use the Website on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The Website is not directed to children under thirteen (13) years of age.

Indy does not knowingly collect, solicit, use, or disclose personal information directly from children under thirteen (13) through the Website without verifiable parental consent as required by applicable law.

Individuals under thirteen (13) years of age may not:

·       Create a Website account;

·       Register for services through the Website;

·       Submit forms through the Website;

·       Subscribe to newsletters or marketing communications;

·       Enter contests, sweepstakes, promotions, or surveys;

·       Post content, comments, reviews, or other submissions; or

·       Otherwise provide personal information through the Website.

By using the Website, you represent and warrant that you are not under thirteen (13) years of age or, where required by applicable law, that verifiable parental consent has been obtained.

If Indy learns that personal information has been collected from a child under thirteen (13) without the consent required by applicable law, Indy may take steps to delete the information, terminate associated accounts, and restrict future access to the Website.

Parents or legal guardians who believe that a child under thirteen (13) has provided personal information through the Website may contact Indy to request review, deletion, or other action regarding such information.

The collection, use, disclosure, retention, and protection of children's information shall be governed by Indy's Privacy Policy and applicable law.

2. PRIVACY POLICY

Your use of the Website is also governed by Indy’s Privacy Policy, available at https://www.indyskipass.com/privacy-policy, which is incorporated into these Terms by reference. The Privacy Policy explains how Indy collects, uses, discloses, and protects information obtained through the Website. If these Terms conflict with the Privacy Policy concerning the collection, use, or disclosure of personal information, the Privacy Policy controls as to that subject.

3. LIMITED LICENSE TO USE THE WEBSITE

Subject to your compliance with these Terms, Indy grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Website solely for your personal, lawful, and non-commercial use. This license does not transfer any ownership rights in the Website or its Content. All rights not expressly granted are reserved by Indy and its licensors.

4. OWNERSHIP; COPYRIGHTS; TRADEMARKS

The Website and all text, graphics, logos, icons, photographs, videos, audio, software, code, interfaces, databases, compilations, selections, arrangements, designs, layouts, functionality, and other materials available on or through the Website (collectively, “Content”) are owned by or licensed to Indy and are protected by copyright, trademark, trade secret, unfair competition, and other intellectual-property laws.

Indy Pass, Indy Ski Pass, their associated names, logos, slogans, service marks, and other branding elements are property of Indy or its licensors. You may not use any Indy name, mark, logo, trade dress, or branding without Indy’s prior written permission. No right, title, or interest in the Website or Content is transferred to you.

5. COPYRIGHT INFRINGEMENT NOTICES; DMCA PROCEDURE

Indy respects the intellectual-property rights of others and expects Website users to do the same. If you believe in good faith that material available on the Website infringes a copyright that you own or are authorized to enforce, you may submit a written notice to Indy’s designated copyright agent containing substantially the following information:

·       A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf;

·       Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by one notice, a representative list of those works;

·       Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to permit Indy to locate the material;

·       Your name, mailing address, telephone number, and email address;

·       A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and

·       A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Copyright notices should be sent to:

Designated Copyright Agent
 Indy Ski Pass, LLC
 [email protected]

Upon receipt of a compliant notice, Indy may remove or disable access to the identified material and take any other action it considers appropriate. A person who believes material was removed or disabled by mistake or misidentification may submit a counter-notification containing the information required by 17 U.S.C. § 512(g). Indy may provide notices and counter-notifications to the affected parties and restore material as permitted by applicable law. Indy may terminate accounts of repeat infringers in appropriate circumstances.

A person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages under applicable law. This procedure is provided for notices concerning material hosted on the Website and is not a general-purpose mechanism for reporting misuse of Indy-owned content elsewhere.

6. PROHIBITED USES

You may not, directly or indirectly:

·       Use the Website or Content in violation of law, regulation, these Terms, or any third-party right;

·       Copy, reproduce, modify, publish, distribute, display, transmit, sell, license, sublicense, create derivative works from, or commercially exploit the Website or Content except as expressly authorized in writing by Indy;

·       Impersonate any person or entity, misrepresent an affiliation, or provide false, misleading, or fraudulent information;

·       Attempt to gain unauthorized access to any account, computer system, server, network, database, or nonpublic portion of the Website;

·       Introduce any virus, malware, ransomware, spyware, malicious code, or other harmful technology;

·       Interfere with the Website’s operation, security, availability, or performance, or impose an unreasonable or disproportionately large load on Website infrastructure;

·       Circumvent or attempt to circumvent authentication requirements, technological protections, rate limits, access controls, robots.txt directives, or other restrictions;

·       Remove, obscure, or alter copyright, trademark, attribution, or other proprietary notices; or

·       Use the Website to harass, abuse, threaten, defame, deceive, or harm another person.

7. AUTOMATED ACCESS; SCRAPING; DATA EXTRACTION

Except with Indy’s prior written authorization, you may not use any robot, bot, spider, scraper, crawler, indexing tool, browser automation tool, artificial-intelligence system, machine-learning system, script, data-harvesting technology, or other automated means to access, monitor, search, copy, download, extract, collect, index, cache, store, or interact with the Website or Content.

Without limiting the foregoing, you may not:

·       Collect or retrieve resort information, pricing, product information, availability, benefits, events, policies, partner information, customer information, redemption-related information, statistical information, or other Website data;

·       Use Website information to populate, enhance, verify, or maintain another website, mobile application, platform, database, service, feed, browser extension, product, or commercial offering;

·       Republish, aggregate, syndicate, redistribute, display, or make Website Content or data available to another person or through another product or service;

·       Use Website Content or data for analytics, benchmarking, market intelligence, competitive analysis, lead generation, customer profiling, or other commercial or non-personal purposes;

·       Use Website Content or data to train, fine-tune, test, validate, ground, improve, or develop an artificial-intelligence model, machine-learning system, large language model, or similar technology; or

·       Circumvent technical measures intended to detect, limit, or prevent automated access or collection.

The absence of a technical measure preventing access does not constitute permission. Any permission Indy grants must be express and in writing and may be conditioned, limited, or revoked at any time.

8. API EMULATION; UNAUTHORIZED INTERFACES

Except with Indy’s prior written authorization, you may not:

·       Access, use, monitor, or interact with the Website through any unauthorized application programming interface (“API”), simulated API, reverse-engineered API, proxy service, middleware service, or other mechanism that emulates, replicates, intercepts, or bypasses Website functionality;

·       Create or attempt to create an API, feed, endpoint, data stream, service, integration, or interface that reproduces, exports, republishes, or redistributes Website Content, data, or functionality;

·       Reverse engineer, decompile, disassemble, decode, translate, adapt, or otherwise attempt to derive or recreate any source code, object code, data structure, protocol, authentication process, nonpublic endpoint, or underlying idea or algorithm associated with the Website, except to the limited extent applicable law expressly prohibits this restriction;

·       Observe, inspect, capture, intercept, record, or replay nonpublic network calls, requests, responses, tokens, credentials, headers, or communications for the purpose of accessing or replicating Website data or functionality;

·       Use an unauthorized interface to automate account creation, authentication, purchasing, form submission, content retrieval, or any other Website activity; or

·       Use the Website or Content to develop, enhance, operate, support, or maintain a third-party application, platform, extension, assistant, service, or product.

9. COMMERCIAL AND COMPETITIVE USE RESTRICTIONS

The Website is provided for personal, non-commercial use. Without Indy’s prior written authorization, you may not use the Website or Content for commercial, professional, institutional, competitive, or other non-personal purposes, including to:

·       Offer or support a mobile application, travel service, reservation platform, ski-related service, tourism product, directory, marketplace, or other commercial offering;

·       Sell, license, rent, sublicense, monetize, redistribute, or provide access to Website Content or data;

·       Create or maintain a resort, pricing, benefit, partner, event, customer, or redemption-related database;

·       Develop, market, operate, improve, or support a product or service that competes with, substitutes for, or derives commercial value from Indy, the Website, or Indy’s relationships;

·       Frame, mirror, mask, or display the Website or Content within another website, application, or service; or

·       Use Indy’s Content, data, branding, or customer relationships to solicit users, partner resorts, vendors, or other persons for a commercial purpose.

10. ACCOUNTS; SECURITY; ACCOUNT SHARING PROHIBITED

If the Website permits account registration, you are responsible for maintaining the confidentiality and security of your login credentials and for activity occurring through your account. You must promptly notify Indy of suspected unauthorized access or use and keep your account information current.

You may not:

·       Share account credentials with another person or entity or permit another person to access the Website through your account;

·       Sell, transfer, lease, sublicense, rent, lend, assign, or otherwise make an account or credentials available to a third party;

·       Use another person’s account without authorization;

·       Create an account using false, misleading, or fraudulent information;

·       Create or use multiple accounts to evade restrictions, suspensions, purchase limits, security controls, or enforcement measures; or

·       Use an account for commercial data collection, automated access, credential trafficking, or any other prohibited purpose.

Indy may require credential resets, additional verification, or other security measures and may suspend, restrict, investigate, or terminate an account associated with suspected credential sharing, unauthorized access, fraud, abuse, or a violation of these Terms. Indy is not liable for loss arising from unauthorized account use to the extent permitted by law. Indy may suspend or terminate any account that Indy reasonably believes was created by or for a child under thirteen (13) years of age without legally sufficient parental authorization.

11. USER SUBMISSIONS

Any feedback, suggestions, ideas, comments, reviews, communications, or other materials you voluntarily submit through the Website (“Submissions”) are non-confidential unless Indy expressly agrees otherwise in writing. You represent that you possess all rights necessary to provide each Submission and that it does not violate law or another person’s rights.

You grant Indy a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free, fully paid license to use, reproduce, modify, adapt, publish, translate, distribute, display, perform, and otherwise exploit each Submission for any lawful purpose. This section does not grant Indy ownership of personal information, which remains subject to the Privacy Policy.

12. ELECTRONIC COMMUNICATIONS

By using the Website, creating an account, submitting information, completing a form, initiating a transaction, or communicating with Indy electronically, you consent to receive communications electronically. You agree that agreements, notices, disclosures, records, and other communications provided electronically satisfy any legal requirement that they be in writing. You are responsible for maintaining a valid email address and monitoring communications sent to it. Marketing communications remain subject to the choices and rights described in the Privacy Policy and applicable law.

13. THIRD-PARTY WEBSITES, SERVICES, AND CONTENT

The Website may contain links to or information concerning third-party websites, services, products, partner resorts, or content. Indy does not control or endorse third-party sites or services and is not responsible for their availability, accuracy, security, privacy practices, terms, products, or conduct. Your dealings with a third party are solely between you and that third party, and your use of third-party sites and services is subject to their terms and policies.

14. ACCURACY; AVAILABILITY; WEBSITE CHANGES

Indy strives to provide useful information but does not warrant that Website Content is accurate, complete, current, reliable, or error-free. Resort information, partner participation, benefits, operating status, events, policies, availability, purchasing opportunities, and other information may change. You are responsible for independently verifying information before relying on it.

Indy may modify, correct, suspend, discontinue, remove, restrict, or replace any portion of the Website or Content at any time, with or without notice, and does not guarantee the continued availability of any feature, functionality, or material.

15. ORDERS AND TRANSACTIONS

Although these Terms govern Website access, the Website may facilitate orders or transactions that are governed by separate product or passholder terms. Indy may refuse, reject, limit, correct, modify, or cancel an order, registration, transaction, or request when permitted by applicable law, including because of suspected fraud, abuse, misuse, a violation of these Terms, a technical or pricing error, product unavailability, security concerns, unauthorized commercial activity, or legal requirements. If Indy cancels a completed purchase, any refund obligation will be determined by the separate terms governing the transaction and applicable law.

16. SUSPENSION; TERMINATION; REMOVAL OF CONTENT

Indy may, in its discretion and to the extent permitted by law, investigate suspected violations and suspend, restrict, or terminate access to the Website or an account; block an IP address, device, credential, or automated process; remove, edit, disable, or refuse to post content; refuse service; cancel an order or transaction as provided above; or take other measures to protect Indy, users, partner resorts, systems, intellectual property, or legal rights. Provisions that by their nature should survive termination will survive, including provisions concerning ownership, prohibited uses, licenses, disclaimers, limitations of liability, indemnification, remedies, governing law, venue, and miscellaneous terms.

17. COPYRIGHT AND INTELLECTUAL-PROPERTY ENFORCEMENT

Indy actively protects its copyrights, trademarks, service marks, proprietary compilations, confidential information, and other intellectual-property and contractual rights. Unauthorized reproduction, scraping, extraction, republication, redistribution, display, transmission, commercial exploitation, creation of derivative works, or use of Website Content may violate these Terms and applicable law. Indy reserves all remedies available at law or in equity, including injunctive relief, actual or statutory damages where available, recovery of costs and attorneys’ fees where authorized, impoundment, and other appropriate relief.

18. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. INDY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SYSTEM INTEGRATION, SECURITY, AND QUIET ENJOYMENT. INDY DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME DISCLAIMERS MAY NOT APPLY TO YOU.

19. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDY AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR LOST-PROFIT DAMAGES ARISING FROM OR RELATING TO THE WEBSITE, CONTENT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF INDY AND THE FOREGOING PERSONS ARISING FROM OR RELATING TO THE WEBSITE, CONTENT, OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

20. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Indy and its affiliates, members, managers, officers, directors, employees, contractors, agents, licensors, and partners from and against claims, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to your use or misuse of the Website; your violation of these Terms or law; your infringement or violation of another person’s rights; your Submissions; or activity conducted through your account. Indy may assume control of the defense of a matter subject to indemnification, and you agree to cooperate with the defense.

21. INJUNCTIVE AND EQUITABLE RELIEF

You acknowledge that unauthorized access, scraping, automated collection, API emulation, copying, extraction, republication, competitive use, infringement, or misuse of the Website or Content may cause irreparable harm for which monetary damages would be inadequate. Indy may seek temporary, preliminary, and permanent injunctive relief, specific performance, or other equitable relief, without the necessity of posting bond to the extent permitted by law, in addition to other available remedies.

22. CHANGES TO THESE TERMS

Indy may amend these Terms from time to time. Updated Terms will be posted on the Website with a revised “Last Updated” date and will become effective upon posting unless a later date is stated or applicable law requires otherwise. Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using the Website.

23. GOVERNING LAW; EXCLUSIVE JURISDICTION AND VENUE

These Terms and any dispute, claim, or controversy arising from or relating to the Website or these Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Subject to any applicable law that does not permit the parties’ agreed forum, exclusive jurisdiction and venue lie in the state courts located in Carroll County, New Hampshire, and the United States District Court for the District of New Hampshire. You irrevocably consent to personal jurisdiction in those courts and waive objections based on venue, forum non conveniens, or similar doctrines.

24. LIMITATION PERIOD

To the fullest extent permitted by law, any claim arising from or relating to the Website or these Terms must be commenced within one (1) year after the claim accrued, or it is permanently barred. This contractual period does not apply where applicable law prohibits shortening the otherwise applicable limitations period.

25. ATTORNEYS’ FEES

In an action to enforce these Terms or protect Indy’s rights relating to the Website, Indy may recover its reasonable attorneys’ fees, costs, and expenses to the extent permitted by contract and applicable law.

26. MISCELLANEOUS

These Terms, together with the Privacy Policy and any policies expressly incorporated by reference, constitute the entire agreement between you and Indy concerning access to and use of the Website. Separate terms may govern purchases, passes, promotions, or other products and services.

If any provision is held invalid, unlawful, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. Indy’s failure to enforce a provision is not a waiver. You may not assign or transfer these Terms or rights under them without Indy’s prior written consent. Indy may assign these Terms in connection with a merger, reorganization, sale of assets, or other business transaction. Headings are for convenience only. The words “including” and “includes” mean “including without limitation.”
